Fees/Admission
All federal, state, and local laws governing retail sales tax must be followed. Each vendor is responsible for complying with all applicable rules and regulations. Failure to comply may result in expulsion from the event without refund. Certificates of Insurance (COI) are required for all vendors. Provide a Certificate of Liability Insurance that includes Products Liability. Name the Dodge City Area Chamber of Commerce as Additional Insured. Coverage must be in effect for all event dates, including setup and teardown. By submitting this application and participating in the Oktoberfest Arts & Crafts Show (“Event”), the undersigned vendor (“Vendor”) agrees as follows, to the fullest extent permitted by law: Assumption of Risk & Release. Insurance Requirement
Liability Waiver & Hold Harmless Agreement
Vendor assumes all risks associated with participation in the Event and hereby releases, waives, and discharges the Dodge City Area Chamber of Commerce, Boot Hill Museum, the City of Dodge City, and all affiliated entities, officers, agents, employees, sponsors, and volunteers (collectively, the “Released Parties”) from any and all liability, claims, losses, damages, or injuries—whether to persons or property—that may arise out of or relate to participation in the Event, including but not limited to those caused in whole or in part by negligence, weather conditions, acts of God, theft, or vandalism.
Vendor agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to Vendor’s participation in the Event, Vendor’s products or services, or the acts or omissions of Vendor, its employees, contractors, or invitees.
Participation in the Event (including submission of this application, payment of fees, or attendance) constitutes acknowledgment and acceptance of these terms.
